Judge Jose Joaquin Silver ruled that Mockus had resigned before the elections from the Green Party on June 9, and was no longer considered a Green Party member.
The ruling was based on public records and verified records from the Green Party that Mockus had previously withdrawn. His retirement from the party was deemed an obvious fact as it was openly made public.
The CNE has still not resolved another lawsuit which challenges Mockus’ registration as a the mayoral candidate for the Alianza Social Independiente. The case was filed because Mockus’ endorsement appears to have been issued irregularly because he had not been a party member for six months with the group before running for a political position with their support, and their statues require.
